Digital Image Personal Use License
This Personal Use License Agreement (“Agreement”) is made between BFAM Crafts (“Licensor”) and you (“Purchaser”,”Customer”) to also be referenced as “Licensee”. By purchasing, downloading, or using the digital image described below (“Image”), the Licensee agrees to the terms of this Agreement.
1. Grant of Licence
The Licensor grants the Licensee a non-exclusive, non-transferable, revocable licence to use the Image for personal purposes only, in accordance with the terms set out below.
2. Permitted Uses
The Licensee may:
•Print the Image for personal use, such as for home or office decoration.
•Display the Image on personal devices (e.g., smartphones, tablets, or computers).
•Include the Image in personal, non-commercial projects (e.g., scrapbooks or private photo albums).
3. Prohibited Uses
The Licensee may not:
•Use the Image for commercial purposes, including advertising, marketing, or resale of any kind.
•Distribute, share, sublicense, or make the Image available for download by others.
•Alter or modify the Image in a way that misrepresents its original purpose or infringes upon the Licensor’s rights.
•Use the Image in a manner that violates copyright or intellectual property laws.
4. Ownership and Copyright
The Image remains the exclusive property of the Licensor. This Agreement does not transfer ownership or copyright to the Licensee. All rights not expressly granted herein are reserved by the Licensor.
5. Attribution
Attribution to the Licensor is not required for private, personal use. However, if the Image is shared publicly (e.g., on social media or blogs), the Licensee must provide credit to the Licensor in the following format:
“Image by [Licensor’s Name or Business]. Used under personal use licence.”
6. Duration of Licence
This licence is effective from the date the Image is purchased or downloaded by the Licensee. The Licence will terminate automatically if the Licensee breaches any term of this Agreement or at the discretion of the Licensor. Upon termination, the Licensee must delete all copies of the Image.
7. No Warranty
The Image is provided “as is,” without any warranties, express or implied. The Licensor disclaims liability for any damages resulting from the use or inability to use the Image.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
By using the Image, the Licensee acknowledges and agrees to the terms of this Agreement.
